1. Acceptance of Terms

Welcome to Utoday! These Terms of Service ("Terms") govern your use of the Utoday mobile application and website (collectively, the "Service") operated by Utoday ("us", "we", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Utoday is Uganda's premier podcast platform that allows users to:

• Stream podcasts from Ugandan radio stations
• Download podcasts for offline listening
• Create personal favorites lists
• Track listening progress
• Access local weather information

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

3.2 Account Security

You are responsible for safeguarding the password and for keeping your account information current. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

You may delete your account at any time through the app settings. We may terminate or suspend your account if you violate these Terms.

4. Content and Intellectual Property

4.1 Podcast Content

All podcast content available through Utoday is owned by the respective radio stations and content creators. We do not claim ownership of any third-party content.

4.2 Our Content

The Utoday app, website, and our original content are protected by copyright, trademark, and other intellectual property laws.

4.3 Usage Rights

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

5. User Conduct

You agree not to:

• Use the Service for any unlawful purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Upload, post, or transmit any harmful content
• Violate any applicable laws or regulations
• Reproduce, distribute, or create derivative works from our content without permission

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Offline Downloads

Downloaded content is for your personal use only and may not be shared, distributed, or used for commercial purposes. Downloaded content may expire and be automatically removed from your device.

8. Third-Party Services

Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party services.

9. Disclaimers and Limitations

9.1 Service Availability

We strive to provide uninterrupted service but cannot guarantee that the Service will be available at all times. We may suspend or modify the Service for maintenance or other reasons.

9.2 Content Accuracy

While we strive to provide accurate information, we do not warrant the accuracy, completeness, or reliability of any content on the Service.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UTODAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Geographic Restrictions

The Service is primarily intended for users in Uganda. Some content may not be available in all regions due to licensing restrictions.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the app or website. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Uganda, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with Ugandan law.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
